The federal regulations set forth minimum standards and guidelines that nursing homes have to follow in order to receive funding from Medicare. If a nursing home fails to follow those regulations, then the nursing home has not provided quality care.

Michigan law provides that even if a resident had a pre-existing condition, the nursing home is still responsible if the nursing home’s negligence caused that condition to worsen or to become harder to treat.
